Michael Rollin Participates in Negotiations with ACLU and School District

Working as a cooperating attorney with the American Civil Liberties Union of Colorado (“ACLU”), Michael Rollin participated in a successful negotiation between the organization and the Boulder Valley School District.   In October 2007, the ACLU asserted that the District’s non-consensual searches of students’ cell phone text messages violated their privacy rights.  As a result, a fruitful negotiation ensued and a new protocol was created that assures the protection of the students’ constitutional rights by requiring the consent of the student or parent before a search can be performed on a cell phone.   It was also agreed that text messages can be searched without consent only in an emergency situation.
