Franchise Litigation

Haynes Trane Service Agency et al. v. American Standard, Inc. was a case RP became involved with after a first trial and appeal handled by other law firms. The first jury trial resulted in judgments against American Standard totaling $18 million. RP represented American Standard in the re-trial of the matter in U.S. District Court in Colorado. In that re-trial, RP attorneys successfully defeated all of the plaintiffs' claims, including claims for breaches of contract and breaches of fiduciary duty. RP attorneys also obtained a jury verdict in favor of American Standard on its counterclaim for fraud, which is expected to amount to several millions of dollars.

Heidrick, et al. v. PDB Sports, et al. was a case in which two Denver Broncos season ticket holders brought a certified class action against the pro football franchise for allegedly charging more for season tickets than the team's lease with the City and County of Denver at the old Mile High Stadium allowed. At trial, the Denver District Court judge hearing the case agreed with RP's lawyers that Plaintiffs had not met their burden of proof and dismissed Plaintiffs' claims at "halftime," following Plaintiffs' presentation of evidence and before RP ever put on the Broncos' defense of the case.
