Anthony L. Giacomini
Partner
Tony Giacomini is a Partner at Reilly Pozner LLP. He focuses on complex, multi-state commercial litigation and class actions, and appellate practice.
Currently, Tony is a trial team member defending AIG's Old Line Life Insurance Company of America in a purported nationwide class action lawsuit brought in state court in New Mexico involving modal premium payments. His responsibilities include brief writing, fact development, witness preparation, and demonstrative evidence design. For the past two years, Tony has been part of a trial team that twice successfully defeated class certification on behalf of Old Line Life in a California Business & Professions Code §17200 lawsuit. In addition to taking and defending depositions, Tony was responsible for drafting the class certification opposition papers. The matter recently settled prior to trial.
Tony is also the managing attorney in several state and federal lawsuits brought by The Variable Annuity Life Insurance Company (VALIC) seeking injunctive relief and damages for theft of its trade secrets by former employees who violate their non-competition/non-solicitation agreements.
Tony's other major focus is representing individuals who are injured as a result of the negligence of others. Serving as manager of these often complex, multi-defendant cases, Tony has gained extensive experience in all aspects of personal injury trial work, including discovery, motions and appellate practice.
Tony was a member of the trial team that represented individuals and business entities in a series of seven state consumer class actions brought against US West (now Qwest) for delays in telephone line installation. After four years of hard-fought litigation, settlement funds totaling $120 million were approved for HRP's clients.
Before joining Reilly Pozner, Tony worked for more than four years as a trial team member in a series of multi-state consumer fraud cases brought on behalf of seven state insurance guaranty associations and over 200 individuals against a regional stock brokerage firm. In his work on those seven cases, Tony prepared for and attended nearly 200 depositions, either examining adverse witnesses or defending his clients. As a trial team member for four jury trials, he assisted with pre-trial motions practice, designed demonstrative exhibits, prepared witnesses for trial testimony, and assisted with voir dire and trial presentation.
